Mobile Wallet Terms & Conditions

 

Use of Third Party Mobile Wallet Functionality

You may choose to use a mobile wallet available through either Apple or Google (“Mobile Wallet”) to receive and view a copy of your billing statements. You cannot pay your bill directly through the Mobile Wallet.  Mobile Wallet will redirect you to our payment website.

You are solely responsible for any and all telecommunications or other connectivity charges incurred through your use of the Mobile Wallet. By proceeding you confirm that you own the phone being utilized and accept any charges associated with use of the Mobile Wallet.

 

Billing Information

You must voluntarily add billing information into your Mobile Wallet. If you choose to utilize Mobile Wallet, you request and authorize The Cincinnati Insurance Company, its subsidiaries and affiliates (“CIC”) to deliver billing statements, notifications, alerts, due dates, amounts due and any other billing information to be sent to your Mobile Wallet as a courtesy notice - all such documents will still be delivered to your account at cinfin.com. Delivery to your cinfin.com account shall remain the official notice to you of any documents. You acknowledge that the Mobile Wallet provider will receive certain confidential information from CIC including, without limitation, your name and account number.

 

Paying Your Bill

You remain responsible for timely paying your bill regardless of whether it appears in your Mobile Wallet. CIC may send billing information as billable events occur, or at regular billing intervals.  Combining policies into billing accounts or removing policies from a billing account may result in the need for you to create new wallet cards or remove inactive cards. Adding and removing wallet cards is solely the responsibility of the User.

Failure to receive notifications to your Mobile Wallet does not absolve you from your responsibility to pay your statement on-time. Policy cancellation may occur for payments not received on-time. Previous billing statements and other documents related to your policies or accounts may be accessed anytime by logging into your account at cinfin.com.

 

Discontinuing Use

Your use of the Mobile Wallet is completely optional and you may stop use at any time by following the procedure the Mobile Wallet provider specifies. You should review and understand the terms and conditions and privacy policy of the Mobile Wallet provider. Any problems that occur while using the Mobile Wallet will be the responsibility of the provider and not CIC.

 

Changes to Terms

We may change these Terms at any time. You agree to any such changes by continuing to keep a Payment Card in the Wallet. The date of the most recent change to these Terms is shown at the top of these Terms. If you do not accept a change to these Terms, you must remove all Payment Cards from the Mobile Wallet.

 

Mobile Wallet Customer Support

CIC is not the provider of the Mobile Wallet and is not responsible for its use and function. You should contact the Mobile Wallet Provider’s customer service if you have questions concerning how to use the Mobile Wallet. CIC is not responsible for any failure of the Mobile Wallet or your inability to use the Mobile Wallet for any transaction.

 

Additional Terms of Use

All information, other than personally identifiable information, that you submit to CIC via the Mobile Wallet shall be deemed and remain the property of CIC. We shall be free to use, for any purpose, any ideas, concepts, know-how or techniques contained in information that you provide to us through use of the Mobile Wallet. We shall not be subject to any obligations regarding information except as expressly stated in CIC’s Electronic Privacy Policy or as required by law.

You understand and acknowledge that the Internet, through which information is transferred to and from CIC through the Mobile Wallet, is not a secure medium. CIC cannot assume any responsibility for any harm, loss or damage you may experience from transmission of information by or to the Mobile Wallet.

 

NO WARRANTY 

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE MOBILE WALLET IS AT YOUR SOLE RISK AND THAT YOU BEAR THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MOBILE WALLET AND ANY SERVICES PERFORMED OR PROVIDED BY THE MOBILE WALLET ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND CIC HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE MOBILE WALLET AND ANY SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. CIC DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE MOBILE WALLET, THAT THE FUNCTIONS CONTAINED IN, OR SERVICES PERFORMED OR PROVIDED BY THE MOBILE WALLET WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE MOBILE WALLET OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE MOBILE WALLET OR SERVICES WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY CIC OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE MOBILE WALLET OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

 

LIMITATION OF LIABILITY

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL CIC BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE MOBILE WALLET, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (E.G., CONTRACT, TORT OR OTHERWISE) AND EVEN IF CIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall CIC’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

The Terms and Conditions are entered into in the state of Ohio and will be governed by and construed in accordance with the laws of the state of Ohio.
